License suspended or revokedEach State within the US has different laws regarding suspending drivers licenses, but generally they cover the same basics. For example, in Alabama you may not get your driver’s license suspended for non-payment of child support, but in California you will.

The laws vary state to state, but not to a great extent. If you tally up all motor vehicle laws from all the US States, there are approximately 50 ways to get your license suspended. It’s a wonder more licenses aren’t suspended. It’s important to point out the difference between getting your license suspended and having your license revoked. With a suspension there is a start date and end date.

You are restricted to a period of time when you would be illegal to drive a motor vehicle. If caught driving even an ATV or snowmobile you suffer the same consequences as driving a car, truck, motorcycle or any other road worthy vehicle. Even if you’re working for something like Hamilton plumbing company, driving their company vehicles to service clients, you are still responsible for your own drivers licence. At the end of the time appointed, you likely will go before a judge and have your permit reinstated. If revoked, however, this could set your life into turmoil since your license is taken away permanently.

The Hows and Whys and What to Dos

license suspensionThere are any number of circumstances that could result in someone losing their driving license. The most obvious is for driving under the influence of alcohol or drugs, but did you know you could have your license suspended if negligent in paying child support? Another sure fire way is if your traffic violations have hit the roof, and they outweigh judicial tolerance. You will get a notice to appear before a judge, and your license will be suspended. Since a court can’t take away your right to livelihood, there are different types of suspensions, some more restrictive than others. Some complete and some partial.

History Of The DMV

California DMVWhen the “horseless carriage” became more common place it was clear that the State would need to make set-up roadway standards for this exciting new invention. Motorized vehicles were becoming ubiquitous, and it was important that regulations be put in place as to who was qualified to drive an automobile, and under what circumstances.

Other concerns regarded care and the building of our roadway system. Building and keeping the roads and bridges in good repair, having a fast acting emergency towing service, street lamps lit and fences mended to prevent livestock from wandering onto the road, initially all came under the Motor Vehicle Department’s jurisdiction. The growing infrastructure of repair and maintenance was later moved to the Division of Public Works and then later the DOT, the Department of Transportation.

Suspension of Your Drivers License

Driving-While-License-SuspendedWhat happens if your license has expired and you’re pulled over while driving? Well it depends on whether you knew it or not. For example, if your license expired because of a missed renewal on your birthday, then it’s not a serious offense. We are all subject to busy lives, and not always on top of the exact time that our driving permit has run past its renewal date. This offense is regarded as a simple civil infraction. Life happens. This generally is treated like an ordinary ticket. A note to the wise, take the option to pay your fine in person rather than just mailing it in. This shows the court that there wasn’t any criminal intent on your part. Showing up in person also may save you points and a few bucks.

If you are aware of driving with a suspended or expired license then you are facing criminal charges. It will show on the record the police officer pulls up on his cruiser’s laptop. Now you’re in trouble! The officer has the option to take you directly to jail, do not pass go and you do not collect $200. Not even your Local Mover Guelph Ontario has the tools to get you out of this sticky mess without a penalty. Instead your vehicle is hauled away and taken to the impound yard. Now you’re the guests of the local lock-up! Then again, you might get lucky – although at this point you should not be counting on luck – the officer may just issue you a ticket with a notice to appear before a judge. The latter is only likely if, #1 the officer isn’t suffering from indigestion #2 you look trustworthy and have no priors #3 the officer’s dog didn’t die that day #4 the person he pulled over prior to you did not have potty mouth. If you find yourself in this situation, you’ll need to hire an attorney.
